John A. Lipinsky
a partner in the firm, concentrates his practice in commercial litigation, bankruptcy, and creditors' rights. Formerly, Mr. Lipinsky was an associate and then partner with the law firm of Rooks, Pitts and Poust. In the commercial litigation area, Mr. Lipinsky has handled matters for business entities of all sizes, ranging from Fortune 100 companies to family owned businesses. Representative matters include: consumer class action litigation, contract actions, business torts, employment litigation, preference actions, liabilities of officers and directors, fraudulent conveyances and minority shareholder suits. In addition, he has litigated numerous cases on behalf of lending institutions involving enforcement of notes, residential and commercial foreclosure, regulatory compliance and lender liability issues. Mr. Lipinsky also has experience in handling appellate matters in state and federal courts.

Mr. Lipinsky has a diverse bankruptcy practice which includes representing secured lenders, landlords, unsecured creditors, creditors' committees, acquirers of troubled companies, debtors in Chapter 11, and out-of-court workouts pending throughout the nation. He has represented sellers and buyers of distressed businesses and assets, with transactions occurring both in and outside of bankruptcy. He has handled workouts and bankruptcies involving all manner of complex corporate issues. Some recent matters that Mr. Lipinsky has worked on include the bankruptcy cases of Kmart Corporation, Fleming Companies, Inc., Factory 2-U Stores, Inc., and TTC, Illinois, Inc. In addition, Mr. Lipinsky successfully represented a large secured creditor before the Illinois Department of Agriculture in the largest grain dealer failure in the history of the Illinois Grain Insurance Fund. Mr. Lipinsky has a reputation of handling matters in an efficient, economic and expedient manner while keeping focused on the practical business points of complex transactions.

Mr. Lipinsky received a Bachelor of Science degree (with highest honors) in Marketing in 1985 from the University of Illinois. After graduation, he worked for two and one-half years at Mobil Oil Corporation in its Marketing Division. Mr. Lipinsky was a member of an original task force designed to increase Mobils market share in the expanding quick lube market. His responsibilities included creating a market strategy, developing a distributor network in bulk oils throughout New England and working with distributors' sales people on key sales calls.

Mr. Lipinsky received his Juris Doctor degree (magna cum laude) in 1991 from the University of Illinois. While attending law school, Mr. Lipinsky was a teaching assistant where he was voted Outstanding Teaching Assistant every semester he taught. He is admitted to the Illinois Bar, the Federal Bar of the Northern District of Illinois and the United States Court of Appeals for the 7th Circuit. He holds membership in the DuPage, Chicago and American Bar Associations.

Born in Boston, Massachusetts and raised in Algonquin, Illinois, Mr. Lipinsky and his family now reside in Wheaton, Illinois.
